Getting a divorce is not a legal requirement before finalizing your property settlement or settling your child care arrangements. For most people, it is more important to settle their children’s arrangements and/or to finalize their property settlement before filing for divorce. It is true that you can certainly obtain a divorce before obtaining a property settlement if you wish to do so, but practicality usually dictates that a property settlement be made either concurrently with or prior to filing for divorce.
