  1. Drafting the documents

  1. Requesting changes and documents to be updated

If you require any changes or need to correct errors, please submit a change request. Those changes will be made in 24 hours.

  1. Signing the Documents

Documents are signed electronically using DocuSign. Once you have given us your approval, we will send you an email containing the Court documents and a code to access them via your mobile phone. Once both parties have signed, we will submit the documents to the Family Court for approval. These documents do not require a witness. We generally expect this stage to take 24 hours.

How long do consent orders take to process in Australia depends on the time of year your application is made and which registry your matter has been allocated to. Since there has been an amalgamation between the Federal Circuit Court and the Family Court, we have generally seen times fall for the approval of consent orders.

If you submit your consent orders towards the end of the year, heading into Christmas, we generally expect a longer wait time. This is because there is a higher volume of consent orders and family law matters generally. If you submit your consent orders early in the school term, we typically see a reduction in the approval time.

Internally, we track the number of days it takes for a set of court orders to be approved. We calculate this based on the last 30 matters that the Family Court has approved, taking into account the time of year, regardless of the registry.

We have observed this number ranging from as high as 68 working days in September 2022 to as low as 8.5 days in February 2023. When we commence your matter, we will inform you of the current estimated timeframe for completion.

We expect the Consent Orders to be approved by the Family Court within 3-4 Weeks.

 

  1. If the court issues a requisition

A requisition occurs when the court requests additional information from the applicants regarding their application. If you require information on a Requisition, please read our post.

Generally, the courts will issue a Requisition, with 4 to 6 weeks allocated for response, depending on the registrar and the complexity of the requisition. During this time, they will allocate tasks they wish to complete, subject to the questions they would like you to address.

Some registrars will address the matter earlier once the documents have been resubmitted; however, there is no guarantee that this will happen.

The family court generally requests 4-6 weeks to address a Requisition. 

 

  1. Releasing the documents from the court.

Once the family court has approved the  Orders, it will pass them to the registry. Sometimes this was processed, and you can expect to see them on the same day. Sometimes, however, it may take 24 to 48 hours, depending on the workload within that particular registry.

We expect sealed Consent Orders to be released from the family court within 24 hours after being approved.
