Consent Orders – The Basics

What are Consent Orders?

When two people separate, they will often want to formalise an agreement they’ve reached as to the division of their financial assets, or the care arrangements for their children.
A Consent Order is made when two parties submit their proposed agreement to the Family Court of Australia or the Federal Circuit Court of Australia, and the agreement is sealed by the Court and made into a legally binding document known as ‘Consent Orders’.

The agreement reached, once made into a court order, has the same legal effect as if the judge had made the Orders after a contested hearing. However you don’t have to go through the expense and stress associated with going through an entire court process. In fact, you don’t even need to go to Court at all.

Consent Orders are an effective and ideal method by which to finalise your financial ties to your ex-partner and allow you to move forward independently and with certainty.

Do I have to attend Court?

If there are no children under the age of 18, you don’t have to attend court for the Divorce hearing.  Also, if you are making the application jointly with your former spouse, you don’t have to attend court either.

Why would we formalise our agreement?

Formalising your agreement by way of court orders means that neither party can change their mind later on. For parenting matters, it gives you certainty that each party will spend the time with their children that the orders say that they will, and the orders can be enforced by the Court in the event that someone doesn’t comply with them. For property settlements, the orders finalise and sever the financial relationship between the parties, so that you can get on with your life knowing that what you earn and what you accumulate after the settlement is yours.
