Whenever possible, we believe that court proceedings should be avoided. Consequently, if one party fails to pay the other money for their interest in the property under the Consent Orders and refinance the property into their name, the non-defaulting party can pursue a court order getting the property sold so they can be paid the proceeds of sale.
