In order to obtain Consent Orders, you must file two documents. To get consent orders, you must first file a document called “Application for Consent Orders”. In the case of a property settlement, this document outlines all your assets and liabilities, along with a table that explains in mathematics what the Consent Orders state in words. The court needs to consider the parties’ contributions to the relationship, as well as any ‘future needs’ issues. Your parenting consent order application will also answer questions pertaining to the children, including their current living arrangements, their health and education, and their financial support.

 

Also, you must file a Minute of Order, which sets out in detail all of the Consent Orders that you are asking the court to issue. You must detail in a property settlement who retains what assets, who pays for what liabilities, and whether assets or liabilities will be transferred between the parties. For a parenting case, you might set out how much time the children will spend with each party including time on special occasions such as birthdays and Christmas. You can also obtain Consent Orders for other things such as travel arrangements, changeover arrangements, supervision, and extracurricular activities for the children.

 

When both documents are filed and they are properly drafted, a Family Court Registrar in Chambers will review the case and, if appropriate, make the Orders you request. If there are problems with your submission, the documents will be returned to you along with a requisition notice that you must complete before resubmitting them to the Court.
